The IPS Gate (“IPS Gate” or “Application”) is a secure, web-based application being offered to surgeons for the purpose of interacting with KLS Martin, L.P.'s (“Provider” or “KLS Martin”) IPS Gate Software (the “Software”) in Individual patient-specific case preparations. The Application and the Software are secured and comply with all applicable standards and regulations, including ISO 13485: 2016, 21 CFR 11, ISO 9001, ISO 27018, ISO 27017, ISO 27001, CISPE, GDPR, and HIPAA/PII/PHI Privacy requirements. 

KLS Martin is committed to protecting your privacy. KLS Martin may collect certain personal data in order to provide you with services through the Application, to enhance the functionality, usability and customer-orientation of the Software, to implement a superior level of customer service and to learn how the Software is used. You have the right to access and rectify personal data collected from you by KLS Martin. Such personal data is used to improve and operate the Software including product ordering, customer service and other services including marketing (e.g. sending product information), for software enhancement, commercial business analysis and evaluation or other similar reason and to communicate with you. 

KLS Martin processes the personal data which we receive from you within the scope of our business relationship. In addition, we process (as needed for the provision of our services) personal data which we have received from third parties in a permissible way (e.g. for the execution of orders, for the fulfilment of contracts or on the basis of your consent). Relevant personal data includes data needed for the identification of a person and contact data (name, address, telephone number and e-mail address), order data and data from the fulfilment of our contractual obligations. 

Personal data is processed as necessary to present our website and to provide the services of IPS Gate and the associated electronic transmission of specific medical data for the creation of individually manufactured implants, templates for marking and/or sawing guidance and, in particular, for the execution of our contracts or pre-contractual measures with you and the execution of your orders. In order to use the member area of IPS Gate, you must first register as a user so that we can guarantee the confidentiality of the information you transmit to us. In particular, we require your name, user ID, e-mail address and a user-designated password in order to identify you as a unique user. We reserve the right to use the registration data you provide to verify that you are a licensed healthcare provider who may use IPS Gate. 

If necessary, we process your data beyond the actual fulfilment of our services to protect the legitimate interests of KLS Martin or authorized third parties. Examples of this include the enforcement of legal claims or defense of legal disputes, ensuring IT security, the prevention or investigation of criminal offenses by the government, and for our business management or product development purposes. In addition, KLS Martin may collect certain information on the use of the Software such as technical information (e.g. CPU speed and operating system), general usability information (e.g. usage of workspaces or shortcuts), actual usage information (e.g. (CB)CT-scanner and radiographic guide used) and commercial information (e.g. planning and ordering pattern). Technical and general usability information will be collected in a strictly anonymous manner. Personal information may be stored and processed by KLS Martin, its group companies and/or authorized third parties such as IT infrastructure providers bound by a confidentiality agreement, obliged to adhere to all applicable data protection laws and regulations, and acting upon instructions from KLS Martin. You agree that your personal data may be processed and transferred to and within other countries. You have the right to object free of charge to the processing of personal information collected from you by KLS Martin. KLS Martin will implement appropriate technical and organizational measures to protect personal data against accidental or unlawful destruction or accidental loss, alteration, unauthorized disclosure or access by unauthorized third parties outside the KLS Martin Group and against other unlawful forms of processing. KLS Martin will only disclose your personal data to unauthorized third parties (which excludes e.g. IT infrastructure providers) outside the KLS Martin Group if required by law or for regulatory purposes. However, you acknowledge and agree that KLS Martin may use and/or disclose your personal data if KLS Martin determines that such use or disclosure is reasonably necessary to comply with legal process or to protect rights, property or personal safety of KLS Martin, its employees, users of the Application, or the public. Like most other websites, we use cookies for the operation of the Application. The log-in function of the Application, for example, requires the use of cookies. By using cookies, we can provide you with more user-friendly services on our website. You can set your browser so that you are informed about the use of cookies and only allow cookies only in certain situations. You can also set your browser to automatically delete cookies when your browser is closed. If you deactivate cookies on your browser, the functionality of the Application may be restricted. If you do not wish to use cookies, you can prevent the installation of cookies by setting your browser accordingly. 

Collected data of Application users (keyword: logfiles) will be deleted at regular intervals.

This link leads to the machine-readable files that are made available in response to the federal Transparency in Coverage Rule and includes negotiated service rates and out-of-network allowed amounts between health plans and healthcare providers. The machine readable files are formatted to allow researchers, regulators, and application developers to more easily access and analyze data.
